NJK Group Limited has this privacy policy in order to demonstrate our commitment to protecting your privacy.  

 

We recognise that your personal information is confidential and that it is important for you to know how we handle, gather, store and use your personal information. By entering any of our stores, using our website, mobile site, apps or store wi-fi or participating in our database and promotions, you acknowledge that we will be using your personal information as detailed in this privacy policy.

This privacy policy applies to any personal information that we collect when you interact with us.  In general terms, this includes any information that can be used to personally identify you.  If the information we collect personally identifies you, or you are reasonably identifiable from it, then the information is considered personal information. We only collect personal information directly from you. For example, when you: 

  • Visit NJK stores;  
  • Use NJK website or our apps;  
  • Use NJK’s loyalty programme;  
  • Any other services we provide now or in the future 

 

2. What personal information do we collect and hold? 

From time to time we may collect or request personal information from you in the course of providing you the services.  We may collect the following types of personal information: 

  • Name, 
  • Mailing or street address, 
  • Email address, 
  • Telephone number; 
  • Age or birth date, 
  • Profession, occupation or job title, 
  • Details of the products and services you have purchased from us or which you have enquired about, together with any additional information necessary to deliver those products and services and to respond to your enquiries, 
  • Any additional information relating to you that you provide to us directly through our websites or indirectly through use of our website or online presence through our representatives or otherwise; and information you provide to us through our customer contact centre or customer surveys, or that is publicly available. 

 

3. Why do we collect personal information? 

The primary purpose for the collection of information is to enable us to provide the best possible services to you as a customer in any format you may wish to engage with us. Your information will not be used in ways that you have not consented to. Your personal information will not be shared, sold, rented or disclosed other than as described within this privacy policy, or as permitted by the privacy act.

  • To allow you to access and view your account created to receive the services or marketing communications; 
  • To assist in providing the services that you request, including to contact you about your use of the services and process and deliver any orders placed through the services. 
  • To allow you to participate in competitions and promotions which may be available to NJK’s customers from time to time;  
  • To contact you for other NJK’s marketing and promotional purposes;  
  • To take actions required to keep your information secure; 
  • To enhance your overall experience of the services; 
  • To provide you or send you targeted marketing (or allow a third party to provide you) via email, online (including social media) or post with details of special offers, discounts, prize draws, loyalty programmes, competitions and information about products or services offered by NJK Group Limited, or other third party providers, information that may be of interest to you, your family or household;  
  • Identify and determine the benefits, offers or promotions that may be of interest to you, your family or household based on your use of the services; 
  • To undertake data analytics, insights or data mining (including the anonymisation or aggregation of your personal information with other data to identify patterns and trends, and use the full benefit of that analysis);  
  • To build a view of you as a customer by collating all personal information that NJK Group Limited hold about you in a single profile across platforms and services so that we can analyse and improve your experience and our services provided to you;  
  • To conduct research related to your use of the services;  
  • Help you complete any application by you to join NJK’s loyalty programme; and 
  • Such other purpose we make known to you at the time of collection. 

 

4. What happens if we are not able to collect personal information? 

If you choose not to provide us with the personal information described within this policy, then: 

  • We may not be able to provide you with the product or services you have requested, either to the same standard or at all, 
  • We may not be able to provide you with information about products or services that you may want, including information about discounts, sales or special promotions, 
  • We may not be able to tailor our content, website and communications for your preferences.

We do this in a variety of ways, including through:

  • Your conversations or email or interaction, between you and our team, whether in store or via customer care interactions. 
  • Your completion of an application for a product purchase or service purchase.

  • Third party companies such as credit reporting agencies, law enforcement agencies, and other government entities,

  • Mailing lists,

6. How do we use cookies? 

A “cookie” is a small text file that is placed on a device when it is browsing a website to enable the host of the website to store information about use of the website by that device.  

 

When you access NJK’s websites, social media pages and/or apps, we may use cookies to track your use of the services so that we can provide you with the best possible shopping experience. Some information/services may be unavailable if you chose to disable your browser from accepting cookies. 

We may use the information generated by cookies for the following purposes:

If you receive communications from us that you believe have been sent to you other than in accordance with this policy, or in breach of any law, please contact us. 

We may also share your information with other companies in NJK Group Limited for the purpose of analysis. Your information will only be used as described within their privacy policy, or as permitted by the privacy act. 

We do not provide your personal information to other organisations for the purposes of direct marketing unless expressly authorised by you. 

 

8.  Do we use personal information for marketing? 

We use personal information to provide you with information or advice about our existing and new products and services. We also use it to conduct promotions on behalf of NJK Group Limited and selected third parties. 

We will not collect usage data or target advertisements based on the following market segments: 

  • Political opinions, 
  • Membership of a political association, 
  • Religious beliefs or affiliations, 
  • Philosophical beliefs, 
  • Membership of a trade union, 
  • Sexual preferences or practices, 
  • Criminal record, 
  • Health information. 

We will not create categories designed to target children under the age of 18 years (however, this does not prevent us from marketing related children’s products to a general audience). 

Third party advertisers may purchase advertising products from us that enable them to target particular types of users of our network, for advertisements served both on our network and also on third party websites. We do not permit advertisers to use any usage data obtained from our network to target advertisements or content to users off our network. We will not provide any personal information to an advertiser or any other third party without your express consent or in accordance with our privacy policy. 

We follow industry “best practice” for the storage of anonymous usage data using reasonable safeguards to protect information held by us. 

 

9. Security of personal information 

Security of personal information is very important to us and we will take all reasonable steps to protect your personal information from misuse, loss, unauthorised access, modification or disclosure.   

However, you acknowledge that security of the transmission of data over the internet can never be guaranteed, and it is your sole responsibility to protect access to any emails you receive from us that provide access to your account. To the maximum extent permitted by law, NJK Group Limited will not be liable for any direct or indirect damage or loss if any third party gains unauthorised access to your information. 

 

10. How can you access or correct your personal information? 

If you make an access request, we will ask you to verify your identity. There may be instances where we cannot grant you access to the personal information we hold. For example, we may need to refuse access if granting access would interfere with the privacy of others, or if it would result in a breach of confidentiality. If that happens, in most circumstances we will give you written reasons for any refusal. 

If you believe that personal information we hold about you is incorrect, incomplete or inaccurate, then you may request us to amend it. We will consider if the information requires amendment and will not charge for making any amendments. If we do not agree that there are grounds for amendment, then we will add a note to the personal information stating that you disagree with it. Registered users of our websites can access and update their user details online. We request that you keep your information as current as possible so that we may continue to improve our service to you. 

 

11. How do we disclose personal information? 

We may disclose your personal information to our employees, for the operation of our websites or our business, and for the specific purpose of fulfilling requests by you, and to provide products and services to you, and where we are permitted to under the privacy act. 

Where NJK Group Limited utilises third parties to undertake services, we may provide those third parties with some of your information if it is required to fulfil those services and only to the extent required to fulfil those services. Examples of such third party providers may include: 

  • Service providers such as web hosting providers, IT systems administrators, mailing houses, couriers, payment processors, photographic analysers, data entry service providers, electronic network administrators, debt collectors, and professional advisers such as accountants, solicitors, business advisors and consultants, 
  • Software providers such as customer relationship management, and accounting software 
  • Existing or potential suppliers, business partners or joint venture entities or partners, 
  • Sponsors, or promoters of any competition that we conduct or promote via our services, 
  • Specific third parties authorised by you to receive information held by us 

We require any third party to protect your information against unauthorised use or disclosure. 

Beyond the above, we release personal information only when it is permitted under the privacy act or required by law for legal compliance and law enforcement (including to government agencies with statutory law enforcement responsibilities, and/or to your internet service provider or network administrator); to facilitate court proceedings; enforce or apply our terms and conditions; or protect the rights, property, or safety of NJK Group Limited, our users, or others, and where we reasonably believe that disclosure is necessary. Government agencies with statutory roles enabling them to request data from us include but are not restricted to the Police, Inland Revenue and the Ministry of Business, Innovation and Employment. 

 

12. Credit card security 

We work diligently to protect the security of your personal information, including credit card information. 

Due to the nature of our business being both online and instore retail we have a number of security checks in place to protect our websites and our customers from such things as credit card theft. Our order system will automatically put orders on hold if it includes such things as high valued items or if a transaction has failed. To release your order you may be asked for identification and proof of address so your order can be approved. Once checked and approved any proof of identity information collected in relation to your order will be deleted and you will be contacted by email to confirm that this has been done. Due to these checks your delivery may also be delayed. 

 

13. Security standards 

We will take reasonable technical and organisational precautions, including complying with generally accepted industry standards, to protect personal information that we hold.  However, no method is completely secure and we are not responsible for any breach of security caused by third parties.  

 

14. Your responsibilities 

You are responsible for ensuring your internet browser and computer system are secure (including, but not limited to, free and secure from viruses) and can support any security measures we use to protect your information.
